Executive Summary:
Adopt text amendments to comply with the changes to the North Carolina General Statutes (NCGS) enabling legislation for local planning and development regulation (160D) that took effect in January of 2021.
Background:
The Unified Development Ordinance requires a few minor amendments to sections relating to the Historic Resources Commission and Certificates of Appropriateness to be compliant with the changes mandated by NCGS 160D.
Issues/Analysis:
The revision of terminology from the use of the term “guidelines” to “standards” is to assure consistency with NCGS §160D-947. Other changes are for clarity on the authority of the Historic Resources Commission.
Budget Impact:
None
Options:
1. Move to approve the revised text as submitted.
2. Remand the revised text back to Staff for further review and modification.
Recommended Action:
Staff recommends that the Planning Commission move to recommend approval of the revised text because the changes are necessary to bring our ordinance into compliance with Chapter 160D of the North Carolina General Statutes.
