Executive Summary:
Payment in-lieu of resurfacing has been collected from utility companies. In accordance with provisions set forth in Chapter 24, Article II, Section 24-72 of the City Code Ordinances, Public Services would like to utilize these funds for the FY23 pavement preservation project to be used for street resurfacing. Capital Project Ordinance Amendment (CPOA) 2025-47 appropriates these revenues in the FY2023 Pavement Preservation project.
Background:
Under Chapter 24, Article II, Section 24-72 of the City Code of Ordinances, utility companies whose work within a City Street degrades pavement to the extent that it meets resurfacing requirements have the option to make a payment in lieu of performing the required resurfacing.
Issues/Analysis:
Per City Code of Ordinances, this payment-in-lieu of revenue shall be contributed to the City’s resurfacing program.
Budget Impact:
There is no impact to the General Fund fund balance as the funding is being appropriated from the dedicated payment-in-lieu of resurfacing proceeds.
Options:
1. Adopt CPOA 2025-47 to appropriate $224,844 of revenue received from payments-in-lieu of resurfacing revenue for the FY2023 Pavement Preservation Program.
2. Do not adopt CPOA 2025-47 and provide further directions to staff.
Recommended Action:
Staff recommends City Council adopt CPOA 2025-47 to appropriate $224,844 of revenue received from payments-in-lieu of resurfacing for the FY2023 Pavement Preservation Program.
