Executive Summary:

The City of Fayetteville is seeking annexation into the corporate limits of the City of Fayetteville. Their proposal entails four parcels, totaling approximately 40.45 acres. These parcels are situated on the south side of Carvers Falls Road, near its intersection with Lamar Road, specifically at 430 and Unaddressed Carvers Falls Road. They are identifiable by their PIN numbers: (PINs):0540089431, 0540184484, 0540188297, and 0540281121.

 

On August 11, 2025 the City of Fayetteville City Council adopted a resolution of intent to annex these properties and set a public hearing for August 25.

 

Background: 

Historical Background:

These properties have been historically undeveloped except for a Public Works Commission (PWC) substation which is located at 430 Carvers Falls Road.

 

Surrounding Environment:

The surrounding area is a mix of undeveloped properties, single family housing and multi-family housing located near the intersection of Carvers Falls Road and Ramsey Street.

 

Future Land Use Map and Plan:

The Future Land Use Map & Plan suggests that this area of the city should develop as Low Density Residential and Office/Institutional development. The Low-Density Residential area is envisioned primarily for single-family homes with the occasional duplex or townhome.

 

Any new developments must comply with the Unified Development Ordinance's regulations, including those related to stormwater management.

 

According to the Public Works Commission Charter, the City Council shall not directly or indirectly require any individual, group, or developer to request annexation of its property by the City in order to receive water service from a water system under the management and control of the Commission.

Issues/Analysis: 

Compliance with North Carolina General Statute §160A-31(g).

A determination of resolution sufficiency was made by the Real Estate Department on August 15, 2025, as detailed in the attached Certification of Sufficiency. Furthermore, the City has passed a resolution in compliance with §160A-31(g).

 

Compliance with the Development Standards of the UDO

The site is currently undeveloped except for a PWC electric substation located at 430 Carvers Falls Road. All future development will be subject to the standards outlined in the Unified Development Ordinance and enforced through site plan and building plan review. 

 

Effective Date:

The North Carolina General Statutes require that annexation of City owned Property that is contiguous be annexed immediately or on June 30 after the date of passage of the ordinance, or on June 30 of the following year after the date of passage of the ordinance. 

 

The initial zoning must be done within 60 days of adoption of the annexation.

 

Financial Impact of Annexation:

If annexed into the City of Fayetteville, there will be no burden of the property tax since the property is owned by the City.

 

Budget Impact: 

Please see the attached Appendix A, which summarizes the financial impact of the provision of services and the assumed tax revenue that the City will receive as a result of annexation. The figures provided assume an annexation date of August 25, 2025.     

Options

1. Adopt the annexation ordinance with an effective date of August 25, 2025;

2. Adopt the annexation ordinance with an effective date of June 30, 2026;

3. Do not adopt the annexation ordinance;

4. Defer action and table the annexation resolution for further review and discussion.

     

Recommended Action::Recommended Action

Staff recommends that the Council move to adopt the proposed ordinance annexing the parcel with an effective date of August 25, 2025.
