Executive Summary:
The City Council Policies Review Committee met on Thursday, August 13, 2026. During the meeting the Committee unanimously approved revisions to two Council policies.
At the January 5, 2026, Work Session, City Council made a consensus motion to send City Council Policy 155.6 - Real Property - Lease back to the City Council Policies Review Committee for further review.
City Council Policy 155.2 - Surplus Property - Disposal of Property Valued at Less than $30,000.00 has not been revised since 2006.
City Council Policy 150.1 - Water and Sanitary Sewer Utility Assessments has not been revised since August 23, 2010.
Background:
Policy 150.1 was created on November 17, 2003, with revisions in 2006 and 2010.
Policy 155.2 - Surplus Property - Disposal of Property Valued at Less than $30,000.00. was created on June 6, 1983, with revisions in 2006.
Policy 155.6 was created on September 17, 2001, and was revised in 2009.
Issues/Analysis:
City Council Policy 150.1 - Water and Sanitary Sewer Utility Assessments
The recommended change includes:
• Section III removes the sentence “In addition, the Council will use Community Block Grant funds to offset the cost of the assessment for low to moderate income property owners”.
• Section IV states Council may use local funds or other available funds to offset eligible water and sewer assessment and connection costs for qualifying property owners through the Utility Connection Assistance Program. Assistance shall be available by application through the City, including application materials made available on the City’s website. Program eligibility requirements, assistance categories, and maximum assistance levels shall be established by City Council and may be amended from time to time. The City Manager or designee may approve administrative procedures, forms, documentation requirements, and implementation guidance consistent with the program structure approved by City Council.
City Council Policy 155.2 - Surplus Property - Disposal of Property Valued at Less Than $30,000.00
The recommended change is to add language regarding the disposal of personal
property and the required advertisement of an item for sale on GoveDeals.com
City Council Policy 155.6 - Real Property - Lease
The recommended changes include:
• Section II outlines the purpose and intent of this policy. The City leases properties to nonprofit and for-profit organizations only, except as to City-owned residential properties, and is accordance with North Carolina General Statutes, particularly N.C.G.S. § 160A-272, and provides a framework for equitable, transparent leasing practices.
• Section III states that the City shall provide public notice of the intent to enter into leases at least 30 calendar days before executing a real property lease. Paragraph B states that leases must remain consistent with the goals and standards of this policy and the City’s Code of Ethics.
• Section III adds Paragraph G that outlines the procedures by the lease terms. Any leases that last a year or less will require a public notice for 30 days before execution is required on social media and City website. The City Manager may approve and execute without City Council action. For leases of more than one year to up to ten years, requires publish advertisement of City Council’s intent to authorize the lease in a newspaper of general circulation. The advertisement must describe the property to be leased, state the annual lease payments, and announce the City Council’s intent to adopt a resolution authorizing the lease at its next regular meeting. Notice must be published once and at least 30 days prior to the regular meeting at which the City Council will adopt the resolution authorizing the lease. Any lease terms of ten years or more must be authorized using one of the three competitive sale methods authorized under Article 12 of Chapter 160A: sealed bid (N.C.G.S. § 160A-268), upset bid (N.C.G.S § 160A-269), or public auction (N.C.G.S. 160A-270).
