Executive Summary:

Approval of resolution rescinding previously adopted demolition ordinance for building deemed dangerous due to fire, where the property owner completed the necessary repairs prior to City executing the demolition ordinance, and the building is no longer considered dangerous.

 

Background: 

To abate a dangerous building condition, staff previously recommended demolition, and the City Council adopted the following demolition ordinance.  The demolition was not executed because the property owner repaired the building to bring the building into compliance before the City took action

The demolition ordinance was filed and recorded with the Cumberland County Register of Deeds as a lawfully authorized abatement action related to the property.

 

Issues/Analysis: 

Because the demolition ordinance was not executed and the property owner repaired the structure, the building is no longer considered dangerous. As a result, the previously adopted demolition ordinance is no longer necessary.

 

However, the demolition ordinance remains recorded in the property records. The proposed resolution would rescind the previously adopted demolition ordinance to reflect that the dangerous condition has been remedied and that the City will not pursue demolition of the structure.

Liens have been assessed against the property for costs incurred by the City in connection with the dangerous building process, including asbestos testing. Those liens remain valid and are not affected by the proposed resolution.

 

Budget Impact: 

$52.00 recording fee with the Cumberland County Register of Deeds.

$513.00 asbestos testing

Adopt the proposed resolution rescinding the recorded demolition ordinance.

Abstain from any action.

Deny the proposed resolution rescinding the recorded demolition ordinance.
