Executive Summary:

N.C.G.S. §160A-299 gives authority and procedures for the City to permanently close a city street or alley. The City received a petition from Cape Fear Valley Hospital Systems  to permanently close approximately 9,312.80 square feet of Fargo Drive to further develop surrounding property. Fargo Drive was dedicated on a plat dated August 1959 entitled “Bordeaux, Section IV” and recorded in the Cumberland County Registry in Plat Book 22, Page 52. The property abutting the street has been recombined to allow for future development in a plat entitled “Recombination And Easement Plat Cumberland County Hospital Systems, Inc.” dated September 2025, and recorded in Plat Book 153, Page 106-108 of the Cumberland County Registry on October 2, 2025.  City Council approved scheduling the public hearing for June 8, 2026, to consider the request on April 27, 2026.  All statutory procedures for notifications have been followed.

 

Background: 

                     Cape Fear Valley Hospital Systems has requested to permanently close a portion of Fargo Drive to allow for development of the surrounding property.

                     N.C.G.S. §160A-299 gives the authority and procedures required for the City to permanently close a city street or alley.

                     This closing will not land lock any abutting property owners.

                     Fargo Drive was platted in August 1959 as part of “Bordeaux, Section IV” recorded in Plat Book 22, Page 52 of the Cumberland County Registry.

                     This portion of Fargo Drive is not utilized as exclusive access to any surrounding properties.

 

Issues/Analysis: 

                     No access will be denied to anyone as a result of the proposed closing.

                     The Emergency Response times will not be affected because the street has never been constructed and opened.

                     There will be no significant impacts to traffic per the City Traffic Engineer.

                     A utility easement will be reserved over the closed portion of the street to enable utilities to remain.

                     Permanently closing the street will allow the surrounding property to be developed further by Cape Fear Valley Hospital Systems.

 

Budget Impact: 

There is no significant impact to the budget as a result of the proposed closing.

    

Options

                     Adopt the Resolution and Order permanently closing a portion of Fargo Drive.

                     Deny the request

Staff recommends that Council adopt the Resolution and Order permanently closing a portion of Fargo Drive.
