Executive Summary:

The Planning Commission is asked to consider the proposed text amendment and make a recommendation to the City Council.

The applicant, REDS of Fayetteville, LLC d/b/a The Renaissance Day Spa & Alternative Wellness, is requesting an amendment to Section 30-4.C.4.i.9 of the Unified Development Ordinance (UDO), which establishes supplemental standards for Personal Service Establishments. The proposed amendment would remove the Office and Institutional (OI) and Neighborhood Commercial (NC) zoning districts from the zoning districts subject to the supplemental standards in Section 30-4.C.4.i.9. The section would continue to apply to Personal Service Establishments in the Mixed Residential 5 (MR-5) zoning district.

Background:

This request arose during preliminary review of the Renaissance Day Spa & Alternative Wellness project proposed for 2900 Village Dr. The property is zoned Office and Institutional (OI), and the proposed facility would combine multiple spa, personal-care, wellness, and administrative functions within one professionally managed establishment.

Section 30-4.C.4.i.9 currently applies supplemental standards to Personal Service Establishments in the MR-5, OI, and NC zoning districts. The standards include:

•                     An individual establishment shall have no more than 2,500 sq. ft. of gross floor area except that in the OI district martial arts and dance studios may exceed this size limitation.

•                     The business activities of the establishment shall be conducted within an enclosed building, with no more than 20 percent of gross floor area devoted to storage.

•                     The establishment shall only sell products at retail and retail sales shall be ancillary to the service or teaching activity.

The applicant states that the existing size limitation does not reflect the operational needs of many modern personal-service establishments that may combine several complementary services, treatment rooms, customer amenities, and administrative functions within one location.

Under the proposed amendment, Section 30-4.C.4.i.9 would apply only to Personal Service Establishments in the MR-5 zoning district. The three standards in the subsection would remain in effect for MR-5, including the 2,500 sq. ft. maximum gross floor area limitation, the enclosed-building and storage requirement, and the limitation on retail sales. Personal Service Establishments in OI and NC would no longer be subject to the supplemental standards in Section 30-4.C.4.i.9, but would remain subject to all other applicable provisions of the UDO.

Issues/Analysis:

The proposed amendment is generally consistent with the Future Land Use Plan (FLUP) and the City of Fayetteville’s Strategic Plan. The amendment supports policies that encourage economic development in designated areas, including Office and Institutional areas, support adaptive reuse and redevelopment opportunities, and encourage flexibility in development regulations to address potential barriers to redevelopment and reinvestment while maintaining appropriate development standards. Specifically, the amendment supports FLUP Policies LU-2.1, LU-2.5, and LU-3.2. In addition, the text amendment supports goals outlined in the City of Fayetteville’s Strategic Plan by encouraging greater flexibility with commercial development.

The proposed amendment would provide greater flexibility for Personal Service Establishments in the OI and NC zoning districts by removing the supplemental standards in Section 30-4.C.4.i.9. The amendment would not remove OI or NC from other applicable UDO requirements. Personal Service Establishments would remain subject to all other applicable development regulations, including requirements related to site development, parking, access, landscaping, buffering, setbacks, building and fire safety, stormwater management, lighting, and compatibility with surrounding properties. The supplemental standards in Section 30-4.C.4.i.9 would continue to apply to Personal Service Establishments in MR-5. The proposed amendment would make the following changes to Section 30-4.C.4.i.9:

•                     Remove OI and NC from the zoning districts subject to the supplemental standards in Section 30-4.C.4.i.9.

•                     Retain the 2,500 sq. ft. limitation and the remaining standards in Section 30-4.C.4.i.9 for Personal Service Establishments in MR-5.

•                     Delete the existing OI exception allowing martial arts and dance studios to exceed the 2,500 sq. ft. limitation, as the exception would no longer be necessary once OI is removed from the subsection.
