Executive Summary:
Council is asked to adopt Capital Project Ordinance Amendments (CPOA’s) 2023-21, 2023-22, and 2023-23 to re-appropriate additional funding to Mable C. Smith Park and to award the contract for the general construction to Mohammad Construction, LLC, the apparent lowest responsive, responsible bidder.
CPOA 2023-21 will reduce the current appropriation of the State Direct Grant funding for facility improvements to the Dorothy Gilmore Therapeutic Recreation Center by $713,320, and CPOA 2023-22 will re-appropriate $272,000 of bond issuance appropriation phase 2 to provide additional funding for park improvements to Mable C. Smith Park.
Background:
On March 15, 2016, Fayetteville voters passed a $35 million bond referendum for parks and recreation projects including several new projects as well as renovations to a few existing parks and facilities. Since voters approved the bond package, several projects have been completed and several more are currently under construction or under design.
Included in the bond package were improvements to the Mable C. Smith Park, including the construction of a 2,900 SF building, expansion of the existing parking lot, a new splash pad, renovated playground, and walking trail improvements. Construction of the splash pad and new playground has been completed.
Also included in the bond package was an appropriation of contingency funding for future appropriations and for facility improvements to Dorothy Gilmore Therapeutic Recreation Center. Dorothy Gilmore Therapeutic Recreation Center received a State Direct Grant in addition to project funding. Staff re-evaluated the project and determined that remaining project funding of $1,375,000 will be sufficient, providing available funding of $713,320 State Direct Grant funds to be re-appropriated through CPOA 2023-21 and CPOA 2023-23 to Mable C. Smith Park for park improvements. CPOA 2023-22 re-appropriates $272,000 of contingency funding through CPOA 2023-23 to provide the remaining needed funds for the award of the contract to the lowest responsive, responsible bidder.
The project was advertised to the general public consistent with North Carolina law, and bids were opened on January 11, 2023. The apparent lowest responsive, responsible bidder for the project is Mohammad Construction, LLC. The bid tabs were as follows:

Issues/Analysis:
Due to the current construction climate, the project cannot be completed with the remaining funds, which as of February 1, 2023, were $1,195,400. The construction contract includes the remaining items: site work (clearing and grubbing, grading, stormwater feature construction, and utilities) the building construction, the construction of additional parking spaces, sidewalks, landscaping, and walking trail improvements.
Budget Impact:
There is no impact to the General Fund.
Options:
1. Adopt CPOA’s 2023-21, 2023-22, and 2023-23 to appropriate the funds needed to complete the improvements to the Mable C. Smith Park, and award and authorize the City Manager to execute a contract with the lowest responsive, responsible bidder, Mohammad Construction, LLC, in the total amount of $1,467,400.
2. Do not adopt CPOA’s 2023-21, 2023-22, and 2023-23 or award the contract and provide further direction to staff.
Recommended Action:
Staff recommends that Council move to adopt CPOA’s 2023-21, 2023-22, and 2023-23 to appropriate the funds needed to complete the improvements to the Mable C. Smith Park, and award and authorize the City Manager to execute a contract with the lowest responsive, responsible bidder, Mohammad Construction, LLC, in the total amount of $1,467,400.
