Executive Summary:
NCGS §160A-299 gives authority and procedures for the City to permanently close a city street or alley. The City of Fayetteville has received a petition from the State of North Carolina to permanently close a portion of Arsenal to allow for the development of the North Carolina Civil War & Reconstruction History Center. The street portion to be closed is between Myrover Street right of way and Martin Luther King Jr. Freeway/NC Hwy 87-401 Business, and will not deny access to any property owners. The Council must adopt a resolution declaring its intent to close the street and call a public hearing on the question. Staff proposes to set the public hearing for June 23, 2025, in accordance with statutory requirements. A resolution and map of the proposed closing are attached for reference.
Background:
• The City of Fayetteville has received a petition to permanently close a portion of Arsenal Avenue to allow for the development of the North Carolina Civil War & Reconstruction History Center.
• NCGS §160A-299 gives authority and procedures required for the City to permanently close a city street or alley.
• This closing of the portion of Arsenal Avenue will not landlock any abutting property owners.
• A map of the proposed closing is attached for reference.
Issues/Analysis:
• No access will be denied to anyone as a result of the proposed closing.
• Closing the street will allow the surrounding property to be developed into the North Carolina Civil War & Reconstruction History Center.
Budget Impact:
There is no significant impact to the budget as a result of the proposed closing.
Options:
• Adopt the Resolution calling for a public hearing.
• Deny the request.
Recommended Action:
Staff recommends adopting the Resolution declaring Council’s intent to permanently close the portion of Arsenal Avenue and calling a public hearing for June 23, 2025.
