Executive Summary:

Seeking approval of resolutions to rescind demolition ordinance previously adopted for the properties at 5523 Meharry Drive and 901 Person Street.

 

 

Background: 

On October 23, 2023 City Council approved Demolition Ordinance NS-2023-023 for the property located at 5523 Meharry Drive.  The demolition ordinance for 5523 Meharry Drive was filed and recorded with the Cumberland County Register of Deeds as a lawfully authorized abatement action to be taken by the City.  Prior to demolition of the building, the owner conducted repairs to address the listed dangerous conditions.  City caused demolition is no longer necessary and the demolition ordinance will not be acted upon. 

 

On November 27, 2023 City Council approved a Demolition Ordinance NS-2023-030 for the property located at 901 Person Street.  The demolition ordinance for 901 Person Street was filed and recorded with the Cumberland County Register of Deeds as a lawfully authorized abatement action to be taken by the City. The owner of the building had been making efforts conduct repairs and was subject to improper actions by the contractor she hired to make repairs to address the listed dangerous conditions.  The City Attorney has recommended that the City rescind the current demolition ordinance permitting the owner to ability to conduct further repairs and renovations.  A notice for a new dangerous building hearing will be issued to the owner as suggested by the City Attorney.

 

 

Issues/Analysis: 

The demolition ordinances will no longer be effective as they were not acted upon.  There are no subsequent liens assessed or recorded against the properties.  The proposed resolutions rescind the previously adopted demolition ordinances.

 

 

Budget Impact: 

$64.00 in recording fees with the Cumberland County Register of Deeds. $349.89 in publication costs for hearing notices.

 

 

Options

-Approve the proposed resolutions rescinding the recorded demolition ordinances.

-Abstain from any action.

-Deny the proposed resolutions rescinding the recorded demolition ordinances.

 

 

Recommended Action: 

Staff recommends the Council move to adopt the proposed resolutions rescinding the demolition ordinances.
