Relationship To Strategic Plan:

Goal 2 - Responsive City Government Supporting a Diverse and Viable Economy

Objective 2.3 - Leverage partnerships for job creation and retention, with focus on local

and regional workforce to increase per capita income.

Executive Summary:

City of Fayetteville does not currently have a City Council adopted program outlining the legal justification, purpose, scope and objectives of a Minority Women Business Enterprise (MWBE) program.

Background:

On June 23, 2021, The City of Fayetteville entered into an agreement with Griffin & Strong, P.C. to conduct a Disparity Study. The scope of the Study included an analysis of current City SLBE program and subsequent recommendations

On September 6, 2022, City Council received the preliminary report on the Disparity study findings and recommendations and fully adopted the Disparity Study on December 5, 2022

The Study adoption included a recommendation to draft an official MWBE Program Policy

Issues/Analysis:

Adoption of a City MWBE Program along with the implementation will provide direct and clear alignment of City Policy and practice to the findings and analysis enumerated in the adopted 2022 Disparity Study. The City program document will be sunset in alignment with the five-year disparity study period, at which time the City Council will be asked to consider and approve an updated policy in alignment with an updated disparity study. Program adoption ultimately creates consistency, accountability, and clear expectations for staff, the public, and contractors doing business with the city.

Granting approval to the City Manager to implement a MWBE Program will assist with the day-to-day implementation of a city policy. The MWBE Program will provide a “how to “, with clear expectations for staff and vendors. The Program creates a path forward with clear processes and procedures for all program elements including corrective measures for any noncompliance

Budget Impact:

None

Options:

1.                     Adopt the MWBE Program as provided by Purchasing.

2.                     Do not adopt the MWBE Program update as provided by Purchasing and provide direction to staff as to next step(s).

Recommended Action:

Recommend the Council adopt the proposed MWBE Program and authorize the City Manager to implement.
