Relationship To Strategic Plan:

Goal 2: The City of Fayetteville will have a Responsive City Government supporting a diverse and viable economy.

•                     Objective 2.2: To invest in community places to ensure revitalization and increase quality of life.

Executive Summary:

City Council is asked to adopt proposed text amendments to the Unified Development Ordinance (UDO) relating to Fayetteville’s Historic Districts and Local Landmarks.

The proposed changes would provide conformity to updates to North Carolina General Statute 160D and require amendments to six sections of the UDO.

Background:

The City of Fayetteville, home to two local historic districts and nearly 50 local landmarks, currently uses the "Design Guidelines for Fayetteville’s Historic Districts and Local Landmarks" to review work within these areas.

To comply with the updated North Carolina General Statute 160D, effective January 2021, these guidelines must transition to Design Standards.

Issues/Analysis:

The revision of terminology from the use of the term “guidelines” to “standards” is to assure consistency with NCGS §160D-947.

Proposed Changes:

•                     UDO 2-41.A - F: Historic Resources Commission

o                     Update the enabling legislation for Historic Resources Commission to reflect updates to 160D that define the powers, duties, responsibilities, and appointments.

•                     UDO 30-2.C.8: Certificate of Appropriateness

o                     Update references to new sections regarding updated process for the creation of new Local Landmarks

•                     UDO 30-2.A.7.A: Powers and Duties

o                     Clarify and distinguish the HRC’s authority and responsibilities separately for Historic Districts and Local Landmarks

•                     UDO 30-3.H.3: Historic Landmark Overlay

o                     Rename overlay to further clarify distinction between Historic Districts and Local Landmarks

•                     UDO 30-2.C.22: Local Landmark Designation

o                     Creation of Local Landmark Designation process separate from the overlay creation process

•                     UDO 30-1-9: Minor Works

o                     Update definition of Minor Works to further clarify distinction between Historic Districts and Local Landmarks

Budget Impact:

None

Options:
