Executive Summary:

Staff is requesting that City Council approve a Municipal Landscape Maintenance Agreement with the North Carolina Department of Transportation (NCDOT) for Project B-4490(L) landscaping and irrigation at the intersection of Bragg Blvd and Rowan Street.  The cost of the project is $49,031.  City Council adopted the FY2024 Budget Ordinance on June 21, 2023, which appropriated $50,000 in the general fund for Project B-4490(L).

 

 

 

Background: 

The North Carolina Department of Transportation (NCDOT) completed Transportation Improvement Project B-4490 to replace the Rowan Street Bridge.  The City entered into a municipal agreement with NCDOT to fund improvements that enhance aesthetics of this gateway corridor approaching the downtown area.

 

On June 13, 2016, Council adopted Capital Project Ordinance (CPO) 2016-22 to appropriate a $382,655 transfer from the General Fund to fund estimated costs for the municipal agreement with the NCDOT for enhancements of the Rowan Street Bridge project including the addition of brick colored stamped concrete medians, black coating on the traffic and pedestrian signal poles, upgraded fencing designs, sleeves for future landscape irrigation, sidewalk, and painting of the outer girders on the bridges.  The appropriation was based upon estimated construction cost for the additional improvements listed above requested by the City. 

 

In May 2020, City staff received final quantities and costs from NCDOT upon completion of construction of the project.  The final construction cost was below the original construction estimate, however, the funding need estimate did not include NCDOT required funding for a share of mobilization and construction engineering and inspection (CEI) costs.  The total project contribution requirement from the NCDOT totals $403,602, including $334,246 in actual construction costs, plus $69,356 to fund 5% mobilization costs and 15% CEI costs associated with the requested additions to the project.  As a result, an additional appropriation of $20,947 was needed to pay final invoices for the municipal agreement. Council adopted the Capital Project Ordinance Amendment (CPOA) 2020-41 to appropriate an additional transfer of $20,947 from the General Fund, bringing the total project appropriation to $406,602.

 

The project consist of planning, design, right of way, utilities, and construction by NCDOT.  Upon completion of plantings, NCDOT will maintain plantings for a period of one (1) year at no expense to the Municipality.  NCDOT does not anticipate the need to relocate and adjust any utilities at this time.  If during the project, it becomes necessary to adjust and relocate utilities, the Municipality, at no expense to NCDOT, shall be responsible for the relocation of adjustment of all utilities in conflict with the landscaping planting.

Issues/Analysis: 

NCDOT requires the execution of the municipal agreement to initiate the Landscape Maintenance Agreement.

 

 

 

Budget Impact: 

There is no budget impact as the funding for this project was included in the original  FY2024 budget ordinance.

 

 

Options

1)                     Approve the resolution authorizing the City Manager to execute the Municipal Landscape Maintenance Agreement with NCDOT for Project B-4490(L).

 

2)                     Do not adopt the resolution authorizing the City Manager to execute the Municipal Landscape Maintenance Agreement with NCDOT for Project B-4490(L).

 

 

 

Recommended Action: 

Staff recommends that Council move to approve the resolution authorizing the City Manager to execute the Municipal Landscape Maintenance Agreement with NCDOT for Project B-4490(L).
