Relationship To Strategic Plan:

Goal 1:  Safe & Secure Community; Goal 4:  Desirable Place To Live, Work & Recreate

Executive Summary:

City Council is asked to adopt resolutions to rescind previously adopted demolition ordinances for two dangerous buildings. The buildings are located at 1805 Ramsey Street and 3248 Chandler Street, and were demolished by the respective property owners before the City could proceed with demolitions.

Background:

To abate the dangerous buildings, staff recommended, and the City Council adopted the following demolition ordinances, which were not executed. The property owners demolished the buildings before the City could act on the related demolition ordinances:

Address                                                                                     Condition                     Ordinance No.                     Abatement Action

1805 Ramsey Street                                           Dangerous                     NS 2023-013                                          Owner demolished

3248 Chandler Street                                           Dangerous                     NS 2024-003                                          Owner demolished

The demolition ordinances were filed and recorded with the Cumberland County Register of Deeds as lawfully authorized abatement actions to be taken by the City on the related properties.

Issues/Analysis:

The demolition ordinances are no longer valid as they were not executed due to voluntary compliance by the property owners. Subsequent liens for asbestos testing costs ($1,412) at 1805 Ramsey Street will be assessed and recorded against the property. No subsequent liens for City demolition costs will be assessed or recorded against 3248 Chandler Street.

Budget Impact:

They City incurred $52 in recording fees with the Cumberland County Register of Deeds to record the demolition ordinances.

Options

1.  Adopt the proposed resolutions rescinding the recorded demolition ordinances.

2.  Abstain from any action.

3.  Do not adopt the proposed resolutions rescinding the recorded demolition ordinances.

Recommended Action:

Staff recommends that Council move to adopt the proposed resolutions rescinding the demolition ordinances.
