Executive Summary:
N.C.G.S. ?160A-299 gives authority and procedures for the City to permanently close a city street or alley. The City received a petition from Sewak, LLC to permanently close approximately 4,386.90 square feet of the street known as McDonald Street to further develop surrounding property. McDonald Street was depicted on a plat recorded on January 12, 1924, but has never been constructed or opened. On March 9, 2026, City Council approved scheduling the public hearing for April 27, 2026, to consider the request. All statutory procedures for notifications have been followed.
Background:
* Sewak, LLC has requested to permanently close a portion of McDonald Street to allow for development of the surrounding property.
* N.C.G.S. ?160A-299 gives the authority and procedures required for the City to permanently close a city street or alley.
* This closing will not land lock any abutting property owners.
* McDonald Street was platted in 1924 as part of the "Map of J.W. Hollingsworth Property Being 2nd. Cedar Rose Addition" recorded in Plat Book 7, Page 137 of the Cumberland County Registry.
* This portion of McDonald Street has never been constructed or opened and is not utilized as access to any surrounding properties.
Issues/Analysis:
* No access will be denied to anyone as a result of the proposed closing.
* The Emergency Response times will not be affected because the street has never been constructed and opened.
