Executive Summary:
The Sole Source Recommendation is for a one-year sole source agreement, with two one-year renewal options, for the purchase of distribution transformers from Electric Research Manufacturing Company (ERMCO) of Dyersburg, Tennessee for Fiscal Years 2027, 2028, and 2029
Background:
The Fayetteville Public Works Commission, during the meeting on April 8, 2026, approved a sole source agreement to purchase specific equipment pursuant to a sole source exception to the competitive bidding requirements, and forward to City Council for approval.
North Carolina law allows an exception from the competitive bidding requirements for "Purchases of apparatus, supplies, materials, or equipment when: (i) performance or price competition for a product are not available; (ii) a needed product is available from only one source of supply; or (iii) standardization or compatibility is the overriding consideration." NC General Statute ?143-129(e)(6).
The request is specifically to authorize a one (1) year sole source agreement with the option to renew for two (2) additional one (1) year terms for the purchase of Distribution Transformers (Overhead, Single-Phase Padmount, and Three-Phase Padmount) manufactured by Electric Research Manufacturing Company (ERMCO) of Dyersburg, Tennessee for Fiscal Years 2027, 2028, and 2029.
