Executive Summary:
Cumberland County has requested that the City of Fayetteville quitclaim their interest in two parcels known as 0415-47-7543 which is located on Dominion Road and 9496-41-3031 which is located on Sudbury Drive to clear up a cloud on title. The County has sold these parcels which were foreclosed on with both the County and City taking title jointly. The first parcel is actually not in the City but was mistakenly put in the City's name with the County when it was foreclosed on. The second parcel was sold without having the City quitclaim their interest prior in error. This will allow the property to be added back to the tax base and not continue to remain in governmental ownership.
Background:
On March 14, 2005, Parcel 0415-47-7543 on Dominion Road and 9496-41-3031 on Sudbury Drive were conveyed to the County of Cumberland and the City of Fayetteville as a result of a tax foreclosure proceeding. The Commissioner's Deed is recorded in Book 6819, Page 5 of the Cumberland County Registry. On October 31, 2006, the County of Cumberland, as Grantor, conveyed said properties out to an outside party but the City of Fayetteville was inadvertently left off. To clear up the cloud on title the County of Cumberland is requesting the City of Fayetteville to quitclaim their interest to the County so the matter can be corrected.

Budget Impact:
There is no significant impact to the budget; however this will enable the properties to be added back to the tax roll.
