Executive Summary:

Council is asked to adopt a resolution authorizing the 6th supplemental municipal agreement with the North Carolina Department of Transportation (NCDOT) providing an additional $1,000,000 in state funds toward the cost of Section C of the Cape Fear River Trail. The revised scope for Section C includes the construction of the trail from the south end of the recently constructed Section A, just north of US 301 (Eastern Blvd), southward to the Cape Fear Botanical Garden property. Capital Project Ordinance Amendment (CPOA) 2018-67 will appropriate the $1,000,000 to the Cape Fear River Trail project.

 

Background: 

On September 23, 2010, the NCDOT and the City of Fayetteville entered into a project agreement for the original scope of construction of the Cape Fear River Trail from Clark Park to the Cape Fear Botanical Garden.

 

The presented agreement is the 6th supplement to that agreement for the design and construction of the Cape Fear River Trail.  The supplement revises the agreement to extend the estimated completion date to December 31, 2019 and to increase the estimated cost and funding for segment C by $1,000,000. The revised scope for Section C includes the construction of the trail from the south end of the recently constructed Section A just north of US 301 (Eastern Blvd) southward to the Cape Fear Botanical Garden property. 

 

The NCDOT is providing the additional $1,000,000 needed to complete the project from its High Impact/Low Cost Project Program.  That program is fully funded by State funds and does not require a local match.

 

 

Issues/Analysis: 

The current agreement does not reflect the additional funding that is being provided by NCDOT, nor does it reflect the updated project completion date.

 

 

Budget Impact: 

There is no impact on the General Fund as no local match is required.

 

 

Options

                     Adopt the resolution authorizing the City Manager to execute the 6th supplemental municipal agreement and adopt CPOA 2018-67 to appropriate the additional $1,000,000 of funding for the project.

                     Do not adopt the resolution or the CPOA and provide further direction to staff.

 

 

 

Recommended Action: 

Staff recommends that Council move to adopt the resolution authorizing the 6th supplemental municipal agreement and also adopt Capital Project Ordinance Amendment 2018-67 as presented.
