Relationship To Strategic Plan:

Goal 2:  More attractive City - Clean and Beautiful; Goal 3:  Growing City, Livable Neighborhoods - A Great Place to Live

Executive Summary:

Approval of resolutions to cancel previously adopted demolition ordinances where the related blighted buildings were repaired by the property owner prior to City caused demolition.

Background:

In order to abate the blighted buildings, staff recommended and the City Council adopted the following demolition ordinances which were not acted upon. The property owner repaired both buildings prior to the City acting on the related demolition ordinance:

Address                                                               Condition                     Ordinance No.                     Abatement Action

1810 Slater Avenue                                          Blight                                          NS 2018-004                                          Owner Repaired

1812 Slater Avenue                                          Blight                                          NS 2018-005                                          Owner Repaired

The demolition ordinances were filed and recorded with the Cumberland County Register of Deeds as a lawfully authorized abatement action to be taken by the City on the related properties.

Issues/Analysis:

The demolition ordinances are no longer effective as they were not acted upon and no subsequent liens for City demolition costs were assessed or recorded against the properties.  The proposed resolution would rescind the previously adopted demolition ordnances.

Budget Impact:

$52.00 in recording fees with the Cumberland County Register of Deeds.

Options

Adopt proposed resolutions rescinding the recorded demolition ordinances.

Abstain from any action.

Deny the proposed resolutions rescinding the recorded demolition ordinances.

Recommended Action:

Staff recommends the Council move to adopt the proposed resolutions rescinding the demolition ordinances.
