Executive Summary:

Council is asked to adopt Capital Project Ordinance Amendment (CPOA) 2019-36 to reduce a prior appropriation of $30,159 to the FY 2019 sidewalk project funded by payments-in-lieu-of sidewalks, and to adopt CPOA 2019-37 to appropriate the $30,159 of payments-in-lieu of sidewalk plus a transfer of $129,841 from the General Fund to provide a total of $160,000 additional funding for the Owen Drive sidewalk project. The additional funds are needed to proceed with a construction bid award and to provide funding for construction inspection and unforeseen contingencies.

 

Council is also asked to award the construction contract for the Owen Drive sidewalk project to Sal Construction, of Cary, NC as the lowest responsive, responsible bidder with a total bid of $581,895. 

 

Background: 

The Owen Drive sidewalk and bus pad project was requested to complement a recently completed NCDOT project to install medians, landscaping and pedestrian traffic signals along the section of Owen Drive from Eastern Boulevard to Walter Reed Road/Old Owen Drive.  The City was previously awarded Federal Highway Administration Surface Transportation funding through NCDOT for this project. 

 

A municipal agreement with the North Carolina Department of Transportation (NCDOT) was approved on March 14, 2016, along with the original project appropriation for $549,000, with approximately 80% or $437,000 provided by the grant funding and 20% or $112,000 provided by the City.  The original appropriation included $54,625 reserved for estimated grant administration costs to be reimbursed to the North Carolina Department of Transportation (NCDOT).

 

Since that time, additional appropriations of $25,000 for right-of-way acquisition and $20,000 for the design of retaining wall and associated inspection costs were adopted by Council, increasing the Owen Drive sidewalk project appropriation to the current total of $594,000.

 

The projected was advertised to bidders and the following was a summation of the bids received.

The recommended lowest responsive, responsible bidder is Sal Construction, of Cary, NC, in the total amount of $581,895.00.

 

Council is asked to approve a new total project appropriation of $754,000, to fund the new contract of $581,895, contingency costs of $12,480, and contracted construction inspection services of $60,000.

 

 

Issues/Analysis: 

The contract cannot be awarded without the additional appropriation, and the project cannot be completed. 

 

 

Budget Impact: 

The FY19 General Fund budget includes sufficient funding to provide the $129,841 transfer. CPOA 2019-36 will move $30,159 previously appropriated to the FY 2019 sidewalk project that has not yet been committed to other uses and can be redirected to this project.

 

 

Options

                     Adopt CPOA’s 2019-36 and 2019-37 and award the construction contract to Sal Construction, of Cary, NC, as the lowest, responsive, responsible bidder in the amount of $581,895.

                     Do not adopt CPOA’s 2019-36 and 2019-37 or approve the bid award and provide additional direction to staff.

 

 

 

Recommended Action: 

Staff recommends that Council move to adopt CPOA’s 2019-36 and 2019-37 as presented, and approve the award of the construction contract to Sal Construction, of Cary, NC, as the lowest, responsive, responsible bidder in the amount of $581,895.
