Executive Summary:

The City of Fayetteville’s Stormwater Division intends on applying for ARPA funding made available by the North Carolina General Assembly Session Law 2021-180 Section 12.14. to fund the remaining Stream Assessments of High Priority Areas through the City’s Watershed Masterplan. 

 

As part of the funding application process, the City is required to submit a resolution that is approved by the City Council. Council is asked to adopt a Resolution of the City of Fayetteville, NC to be included in applications for funding offered by NC DEQ Division of Water Infrastructure. The resolution is attached for reference. 

 

Background: 

North Carolina General Assembly Session Law 2021-180 Section 12.14 established the Local Assistance for Stormwater Infrastructure Investments (LASII) fund to provide grants to eligible entities for projects that will improve or create infrastructure for controlling stormwater quantity and quality. Section 12.14.(d) defines an eligible entity as: “a city  or county that (i) documents in a form and manner as the Department may specify a stormwater quality or quantity issue and (ii) demonstrates that it would experience a significant hardship raising the revenue necessary to finance stormwater management activities within its jurisdiction based on income and unemployment data, population trends, and any other data determined relevant by the Department.

 

The new Local Assistance for Stormwater Infrastructure Investments (LASII) grants are available for stormwater quality and stormwater quantity infrastructure construction projects, stormwater planning grant, and for developing and implementing a new stormwater utility. Staff has identified the remaining stream assessments of high priority areas through the City’s Watershed Masterplan as an eligible project that rates favorable for inclusion in this grant program. 

 

 

Issues/Analysis: 

None. This does not obligate the City to expend any funds, but does allow for the City to apply for the ARPA funding.

 

 

Budget Impact: 

None.

 

 

Options

1.                     Adopt the Resolution of the City of Fayetteville, NC to Be Included in Applications for Funding Offered by NC DEQ Division of Water Infrastructure.

 

2.                     Do not adopt the Resolution of the City of Fayetteville, NC to Be Included in Applications for Funding Offered by NC DEQ Division of Water Infrastructure and provide additional guidance to staff.
