Executive Summary:
NCGS ?160A-299 gives authority and procedures for the City to close a city street or alley. The City of Fayetteville has received a petition to close a portion of Joseph Street to allow the redevelopment of the parcels located along a portion of Joseph Street and Swain Street. The street portion to be closed will not deny access to any property owners due to an Access Easement Agreement that has been recorded in Book 11910, Page 542 of the Cumberland County Registry. The first step in the process dictated by NCGS ?160A-299 is to have a resolution signed granting the public hearing to consider the closing. Staff would like to set the public hearing for May 13, 2024, which would allow the statutory procedures to be followed. A resolution and map of the proposed closing are attached for reference.


Background:
* The City of Fayetteville has received a petition to close a portion of Joseph Street to allow for the development of the surrounding parcels.
* Once the street closing is complete a developer is proposing to purchase all the adjacent property and recombine into a commercial development.
* NCGS ?160A-299 gives authority and procedures required for the City to close a city street or alley.
* This closure will not land lock any abutting property owners due to the Access Easement Agreement being recorded. The Easement Agreement will not be needed once all the property is purchased and recombined as proposed.
